Alimony not an entitlement, says Delhi High Court in landmark ruling

In a decisive verdict that sharpens the line between need and entitlement, the Delhi High Court has ruled that permanent alimony cannot be granted to a financially independent spouse, reaffirming that such relief is reserved for those facing genuine economic hardship.

A Division Bench of Justices Anil Kshetarpal and Harish Vaidyanathan Shankar dismissed the plea of a senior Indian Railways officer, who had sought alimony and compensation from her estranged husband — an advocate — following their divorce.

The couple, married in 2010 and separated after just a year, had their marriage dissolved by a family court in August 2023 on grounds of cruelty. The woman also challenged the family court’s finding that she had subjected her husband to cruelty — a conclusion that had weighed against her alimony claim.

The High Court, in its October 17 judgment, noted that the petitioner did not oppose the divorce itself but appeared motivated by financial considerations. “When a spouse, while ostensibly resisting the dissolution of marriage, predicates consent thereto upon payment of a substantial sum, such conduct inevitably indicates that the resistance is not anchored in affection or reconciliation, but in pecuniary considerations,” the Bench observed.

Invoking Section 25 of the Hindu Marriage Act, the court underscored that the grant of alimony is rooted in equity and judicial discretion — contingent upon factors such as income, property, conduct, and financial capacity of both parties. “The provision is fundamentally equitable in nature,” the judges said, “aiming to secure financial justice between spouses so that a party lacking independent means is not left destitute after divorce. However, such relief is not automatic and must be backed by proof of genuine financial necessity.”

Noting that the petitioner was a Group ‘A’ government officer with a stable income and no dependents, the court concluded that she was fully capable of sustaining herself. “Permanent alimony,” the Bench clarified, “is a measure of social justice — not an instrument of enrichment or financial equalization between two capable individuals.”

By rejecting the claim, the Delhi High Court reaffirmed the underlying spirit of matrimonial law: alimony is a shield against destitution, not a reward of privilege.
